The company ARTLEX II (hereinafter " Cabinet Artlex ") is a private practice company with limited liability, with a capital of 50,000 euros, registered in the register Trade and Companies of Nantes under number 453 475 444, whose registered office is located at 2, Place de la Bourse in Nantes.

Concerned about the protection of personal data, the Cabinet ARTLEX respects the law  n ° 78-17 of January 6, 1978 relating to data processing, files and freedoms as modified (here- after " LIL ") and European Regulation 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data personal data and the free movement of this data, known as the General Data Protection Regulation or GDPR (hereinafter “ RGPD ”).

In the event of non-communication of this mandatory information, Cabinet ARTLEX will not be able to respond to your request for information, contact, appointment or estimate. These requirements for the provision of personal data are of a contractual nature.

 

  • For the execution of contracts, the management of customer relations, complaints, the collection of the following personal data is mandatory : surname, first name, telephone number (landline and/or mobile) , e-mail address, postal addresses (delivery address, billing address). In the event of non-communication of this mandatory information, Cabinet ARTLEX will not be able to execute the contracts, manage the customer relationship, and follow up and respond to your complaints. These requirements for the provision of personal data are of a contractual nature.

 

  • For the management and processing of your applications, the collection of the following personal data is mandatory : surname, first name, e-mail address or postal address or telephone number, diplomas obtained, professional experience, information relating to the position for which you are applying. In the event of non-communication of this mandatory information, Cabinet ARTLEX will not be able to respond to your application. These requirements for the provision of personal data are of a contractual nature.

 

  • For the sending and management of newsletters, information messages on the life and activity of Cabinet ARTLEX and wishes and invitations to events organized by Cabinet ARTLEX, the collection of your e-mail address or postal address is mandatory. . In the event of non-communication of this information, Cabinet ARTLEX will not be able to send you newsletters and/or information messages on the life and activity of Cabinet ARTLEX and/or wishes and invitations to events. Article 3 – Purposes and legal basis of the processing of your personal data

Pursuant to the LIL and the GDPR, any processing of personal data must, to be lawful, be based on one of the legal bases set out in Article 6 of the GDPR.

The table below sets out the different purposes that may be pursued when processing your personal data and the legal bases on which the pursuit of each of these purposes is based.

 

Article 4 - Recipients of your personal data 

The personal data collected by the Cabinet ARTLEX   are intended for authorized staff of the Cabinet ARTLEX.

Cabinet ARTLEX may be required to communicate data :  

  • to its subcontractors (transport service provider, IT service provider, technical service provider, payment service provider, identity verification provider, analytical solutions provider, collection companies and credit organizations, third parties likely to place cookies on the terminals when you consent). Article 5 – Your rights 

You have under the conditions defined in articles 15 and following of the GDPR, with exceptions :

  • the right to receive the personal data that you have provided to Cabinet ARTLEX, in a structured, commonly used and machine-readable format, and/or to ask Cabinet ARTLEX to transmit this data to another controller, when the processing is based on consent or on the contract and the processing is carried out using automated processes (right to data portability – article 20 of the GDPR) ;

 

  • the right not to be the subject of a decision based exclusively on automated processing which produces legal effects concerning you or similarly significantly affects you (right not to be the subject of an automated individual decision – GDPR Article 22) ;

  • the right to object to the processing of your personal data for prospecting purposes (right to object to prospecting – article 21.2. of the GDPR) ;

The existence or not of these different rights depends in particular on the legal basis of the processing concerned by the request. These rights are not without limits either and, in certain cases, the Cabinet ARTLEX may therefore refuse your request (for example for compelling legitimate reasons with regard to the right of opposition). Thus, in certain cases, it is possible that Cabinet ARTLEX responds that your request cannot give rise to a positive response on its part and Cabinet ARTLEX will explain the reason why it cannot comply.

In the event of reasonable doubt on the part of Cabinet ARTLEX as to your identity, Cabinet ARTLEX may be required to request additional information or documents in order to verify your identity (for example, in certain cases, a copy of the front in black and white of your identity card).

Cabinet ARTLEX strives to respond to your  requests within a reasonable time and, in any event, within the time limits set by the regulations in force.

You also have the right to lodge a complaint with the competent supervisory authority, which is in France, the CNIL and to lodge an appeal against Cabinet ARTLEX with the competent courts if you believe that Cabinet ARTLEX has infringed your rights in terms of personal data.

You can claim full compensation for the damage suffered.

Article 6 - Duration of retention of your personal data

The personal data collected by Cabinet ARTLEX is kept for the time strictly necessary for the purposes described above in Article 3.

At the end of the periods previously listed, your data will be subject to either deletion or anonymization.

By way of exception, in the event of pre-litigation or litigation, all or some of your data may be subject to prolonged retention if it proves useful for said pre-litigation or litigation.

Article 7 – Security of personal data

Cabinet ARTLEX makes its best efforts by taking all appropriate measures to ensure the security and confidentiality of your personal data to prevent them from being damaged or distorted or from unauthorized third parties having access to them and misusing them. .  

 

Cabinet ARTLEX implements technical and organizational measures to ensure appropriate security of your personal data, including:

  • Management and control of access to personal data;

  • Installation of monitoring software for Cabinet ARTLEX's computer network;

  • Installation of antivirus and firewall ;

  • Restricted access to the server by username and password ;

  • Regular evaluation of the integrity of the means of protection ;

  • Protection of physical documents in progress.

 

Article 8 – Transfer outside the European Union

Cabinet ARTLEX uses partners or service providers to whom it needs to transfer all or part of the data it collects and processes. The servers of some of these players are located outside the European Union, your data will then be transferred outside the European Union.

Cabinet ARTLEX ensures that these transfers of personal data outside the European Union are carried out in accordance with its Privacy Policy. When the State of destination of the personal data which is not a member of the European Union has not been officially recognized as offering an adequate level of protection by the European Commission, the Cabinet ARTLEX undertakes to provide the appropriate guarantees to protect your personal data, in accordance with Article 46 of the GDPR, in particular through the use of standard contractual clauses approved by the European Commission.
